TERMS AND CONDITIONS 

Bin Beast Terms and Agreements

This Agreement governing the terms and conditions of your use of the Bin Beast (“Bin Beast”) service(s), is between you (“you” or “Customer”), as an authorized user of such services, and Bin Beast
(The Service(s)).

This Agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Bin Beast (collectively, the “Agreement”), constitutes the entire agreement between Bin Beast and you regarding the Bin Beast cleaning service. By using the service(s), you confirm your acceptance of, and agree to be bound by, this Agreement.

SERVICE(S)

​

Bin Beast offers trash can cleaning services, weekly trash can to curb and, also, offers other power washing services. Trash can cleaning services are monthly (12 times per year) and  Quarterly (4 times per year) plans, and a one-time cleaning service as well. Your scheduled cleaning will happen on the day of or the day after your trash service company empties your bins. Each cleaning plan requires a minimum of 3 back-to-back services before the plan can be canceled. Examples: Monthly plan requires 3 months of service and Quarterly requires 9 months of service. If you cancel before these terms, as listed above, then the one-time cleaning fee will be charged for all previous cleanings. All bin cleaning plans include up to 2 bins. Additional bins may be added for an extra discounted cost. You are not allowed to switch bins between cleanings. ie if you sign up for standard cleaning (2 Bins), your additional bin(s) cannot be substituted. Let us know if you would like us to do a one-time cleaning of your additional bin(s) during your service period and we can add the additional bin(s) for a discounted price.

Customer Responsibilities:


In order for Bin Beast to provide its trash can cleaning service YOU MUST ABIDE BY THE FOLLOWING CONDITIONS or service could be interrupted or postponed:
  a. Trash can(s) must be easily accessible (curbside) to service personnel for scheduled services. 

  b. Trash can(s) must be free of excessive cooking/motor oils or un-bagged animal waste and cat litter.
  c. Trash can(s) must be free of chemicals, fresh paint, glue or other adhesive, or hazardous waste of any kind.
  d. Trash can(s) must be free of building materials, e.g. plaster, stucco, or concrete.

  e.Trash can(s) must be free of hazardous items, like hypodermic needles.

 

In order for Bin Beast to provide its Can to Curb service YOU MUST ABIDE BY THE FOLLOWING CONDITIONS or service could be interrupted or postponed:

  a. Trash can(s) must be in the agreed-upon location

  b. Access to trash cans must be available 24 hrs before you scheduled trash pick up day 

  c. Trash can(s) must be accessible by service personnel  

  d. All trash must be inside the trash can(s) 

  e. Trash can(s) must not be overflowing if the lid can not close it will be at the service personnel's discretion to complete the service. 

  f. Access to the agreed-upon location must be available to return can(s) otherwise can(s) will be placed by the customer's garage door.

If you fail to observe the conditions listed above, Bin Beast has the right to refuse to provide you with the service(s), and you will still be responsible for any and all payments/fees. If you contact us within 3 days of your missed service(s), we will attempt to reschedule your missed service(s) for the following trash collection day. Your next service(s) date will commence as usual.

 

Bin Beast responsibilities:


If Bin Beast fails to provide its service(s) on the scheduled time of service(s) for a reason other than the customer failing to meet its responsibilities in the paragraph above, Bin Beast will compensate the Customer by one of the following methods at its sole discretion: Arranging for the service(s) to be performed on the next trash collection day, crediting the customer for the missed service(s) or extending the service contract.

Modifications to Customer Agreement
Bin Beast may amend this Agreement at any time by (a) posting a revised Customer Agreement at www.binbeastcleaning.com, and/or (b) mailing or sending information regarding the amendment to the email address you provided to Bin Beast. We welcome all inquiries, questions, and comments regarding any changes made to the agreement from our clients. Our goal is to always serve our clients to the best of our ability and any changes to the agreement would be solely made for the betterment of the service program.

 

Modifications to Service(s)
Bin Beast reserves the right to modify our delivery of service(s) for the betterment of our clients and the overall success of the service program.

Charges

You agree to pay all charges for your use of the service(s) at the prices then in effect for your area. All plan charges will have any legally required sales tax added to the final price. Bin Beast reserves the right to change prices or institute new charges for access to or use of the service(s). Any changes in pricing will be communicated to you by telephone, mail, or email.

Each plan can be prepaid monthly, prepaid annually, or pay as you go and is paid by using the credit card or debit placed on file during the initial setup of service, and each payment will be recurring per the chosen plan. Plans may be canceled at any time after the minimum service requirement, as stated above, by contacting Customer Service at 843-704-2277. At least a two-week notice is required, before canceling any of the plans. All plans on recurring payments will prorated and charged on a yearly or monthly basis. Any customer who chooses not to be on the recurring payment plan agrees to have their credit/ debit card on file charged automatically on the day of service(s).

If payment by credit/debit card to Bin Beast is not honored or fulfilled by the issuer of your credit or debit card (or its agent or affiliate), you agree to pay all amounts due upon demand by Bin Beast. Each time you use the service(s) you agree and reaffirm that Bin Beast is authorized to charge your designated card. Your card issuer’s agreement governs your use of your designated card in connection with Bin Beast and you must refer to that agreement with respect to your rights and liabilities as a cardholder.

Except for showing acceptable proof that you have relocated to an area where Bin Beast does not provide service(s), your service fees that are paid in advance are non-refundable. If you have any questions regarding any charges that have been applied to your account, please contact Bin Beast customer service department within 30 days of the charge date.

You must promptly notify Bin Beast of changes to: (a) the account number or expiration date of your designated credit or debit card; (b) your billing address (for the designated credit or debit card); and (c) promptly notify Bin Beast if your card is canceled (e.g., for loss or theft).

Bin Beast reserves the right to suspend or terminate your service(s) without notice upon rejection of any credit or debit card charges or if your card issuer (or its agent or affiliate) seeks the return of payments previously made to Bin Beast when Bin Beast believes you are liable for the charges. Such rights are in addition to, and not in lieu of, any other legal rights or remedies available to Bin Beast.

MISCELLANEOUS

a. The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights.
b. If any part, term, or provision of this Agreement is held to be illegal or unenforceable neither the validity nor enforceability of the remainder of this Agreement shall be affected.
c. Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party.
d. This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently and, saves as may be expressly referred to or referenced herein, supersedes all prior representations, writings, negotiations or understandings with respect thereto.
e. Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil commotion, or industrial dispute. If such delay or failure continues for at least 30 days, the Party not affected by such delay or failure shall be entitled to terminate this Agreement by notice in writing to the other.
